In a sadly unsurprising update to our story three days ago, the Wisconsin state attorney general has filed an emergency motion to the 7th circuit court of appeals to prevent Brendan Dassey from getting supervised release tomorrow. Dassey is the nephew of Stephen Avery, both of whom were charged in the murder of Teresa Halbach in 2007 and became the subjects of the Netflix documentary Making A Murderer. (Avery was charged with murder; Dassey as an accessory.) The motion, filed by Attorney General Brad Schimel, who should probably go watch Dassey’s taped confession, asks that a panel of judges review Dassey’s case and whether his release was properly handled; if the court doesn’t rule by tomorrow night, Dassey could still walk free (under supervised release). However, if the 7th circuit court eventually rules against him, he could still be re-jailed in the coming days or weeks.
UPDATE: According to the Herald Times Reporter in Wisconsin, Brendan Dassey will stay in jail. In an update published on the Bluhm Legal Clinic’s Wrongful Convictions Of Youth website, Dassey’s lawyers simply wrote, “The Seventh Circuit Court of Appeals has ruled that Brendan Dassey must stay in prison until his appeal is resolved. We are disappointed more than words can say. The fight goes on.”
